OVERVIEW
This website and online store are operated under the name WE SPEAK CONSTRUCTION™.
Throughout these Terms of Service, the words “we,” “us,” and “our” refer to WE SPEAK CONSTRUCTION™ and the owner and operators of this store. The words “you” and “your” refer to customers, visitors, and other users of our website and services.
By visiting our website, placing an order, creating an account, or otherwise using our services, you agree to these Terms of Service and the policies referenced in them. Please do not use our website or purchase products if you do not agree to these terms.
Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.
1. ONLINE STORE USE
You must be at least the age of majority in your state or place of residence to make a purchase from our store.
You agree to provide accurate, current, and complete information when placing an order. You are responsible for keeping your account information and login credentials secure.
You may not use our website or products for any unlawful, fraudulent, abusive, or unauthorized purpose.
2. PRODUCTS
We make reasonable efforts to display our products, artwork, colors, measurements, and descriptions accurately. However, colors and product appearance may vary slightly depending on your screen, device settings, garment material, manufacturing process, and print or embroidery method.
Product photographs may include lifestyle images or digital mockups intended to demonstrate how a product may look when worn or used.
Most products sold by WE SPEAK CONSTRUCTION™ are custom printed or embroidered after an order is placed. Minor variations in print placement, embroidery, texture, sizing, or color may occur and are not necessarily defects.
We reserve the right to change, discontinue, limit, or update any product or product description without notice.
3. ORDERS
Placing an order is an offer to purchase the selected products. We reserve the right to accept, decline, limit, or cancel any order for reasons including suspected fraud, pricing mistakes, product unavailability, payment issues, or incorrect product information.
Your order is not final until payment has been authorized and the order has been accepted for production.
Please review all product selections carefully before submitting your order, including size, color, quantity, design, and shipping address.
Because products are generally made to order, changes or cancellations may not be possible after production begins.
If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method.
4. PRICES, PAYMENTS, AND TAXES
Prices are shown in United States dollars unless otherwise stated.
Prices, discounts, promotions, products, and availability may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.
Shipping charges and applicable taxes may be added during checkout.
Payments are processed through Shopify and its authorized payment providers. We do not directly store complete credit-card information.
You represent that you are authorized to use the payment method submitted with your order.
5. SHIPPING AND DELIVERY
Products require time for production before shipment. Processing and delivery times shown on our website or during checkout are estimates and are not guaranteed.
Orders may be produced and shipped by third-party fulfillment providers. Products within the same order may arrive in separate packages.
We are not responsible for delays caused by carriers, weather, incorrect addresses, customs processing, labor disruptions, emergencies, or circumstances beyond our reasonable control.
Customers are responsible for providing a complete and accurate shipping address. Additional costs caused by an incorrect or incomplete address may be the customer’s responsibility.

6. RETURNS, REPLACEMENTS, AND REFUNDS
Our products are generally made specifically for each order.
We do not ordinarily accept returns or exchanges because of an incorrect size or color selection, change of mind, buyer’s remorse, or personal preference regarding fit, style, or appearance.
Damaged, defective, misprinted, or incorrect products must be reported within 30 days of delivery. Customers may be asked to provide an order number, description of the problem, and clear photographs.
Approved claims may be resolved through a replacement, reprint, or refund, depending on the circumstances.
Our complete Return and Refund Policy is available through the store and checkout footer and is incorporated into these Terms of Service.
Nothing in these Terms limits rights that cannot legally be limited under applicable consumer-protection law.
7. INTELLECTUAL PROPERTY
The website and its contents, including names, trademarks, logos, artwork, slogans, graphics, photographs, videos, text, designs, product concepts, and other materials, are owned by or licensed to WE SPEAK CONSTRUCTION™, except where otherwise indicated.
You may not copy, reproduce, modify, distribute, sell, license, publish, display, or commercially exploit our content without prior written permission.
WE SPEAK CONSTRUCTION™, BUILT HARD™, TRADE PRIDE™, and other names, logos, designs, and slogans displayed by us may be protected trademarks or proprietary brand assets.
Shopify and other third-party names and logos belong to their respective owners.
8. CUSTOMER CONTENT AND FEEDBACK
When you voluntarily submit reviews, photographs, comments, suggestions, or other content to us, you confirm that you have the right to submit it.
You grant us permission to use, reproduce, edit, display, and share that content for purposes related to operating, improving, and promoting our business, unless we agree otherwise in writing.
You may not submit content that is unlawful, deceptive, threatening, defamatory, obscene, infringing, or harmful.
9. THIRD-PARTY SERVICES AND LINKS
Our website may use or link to third-party platforms, payment processors, shipping providers, fulfillment companies, social-media services, applications, or websites.
We do not control and are not responsible for the content, security, availability, policies, or practices of independent third parties.
Your use of third-party services may be subject to separate terms and privacy policies.

Because our store is hosted by Shopify, information may also be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer service.

Occasionally, product descriptions, prices, promotions, shipping charges, availability, or other information may contain errors or omissions.
We reserve the right to correct errors, update information, cancel affected orders, or make appropriate adjustments, including after an order has been submitted.
If an error materially affects an accepted order, we will make reasonable efforts to contact the customer.
13. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, our website, services, information, and products are provided on an “as available” and “as is” basis, except for any express rights or warranties required by law.
We do not guarantee that the website will always be uninterrupted, secure, timely, or error-free.
We do not guarantee that every product will appear exactly the same as a photograph, mockup, or screen display.
This section does not exclude warranties or consumer rights that cannot legally be excluded.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, WE SPEAK CONSTRUCTION™, its owner, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website, products, or services.
Where liability cannot legally be excluded, our liability will be limited to the amount permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless WE SPEAK CONSTRUCTION™, its owner, employees, contractors, affiliates, and service providers from claims, liabilities, losses, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.
16. SEVERABILITY
If any portion of these Terms is found to be invalid or unenforceable, that portion will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
17. NO WAIVER
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.
To the extent legally permitted, disputes relating to these Terms or our services will be handled in the appropriate courts located in San Diego County, California.
Nothing in this section prevents a consumer from exercising rights or using a forum provided by applicable law.
19. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time.
The current version will be posted on this page with an updated effective date. Continued use of our website after a change becomes effective constitutes acceptance of the revised Terms, except where additional notice or consent is legally required.
